Terms Used in This Policy
MoodBoss Service – an online resource that is a combination of information and intellectual-property objects contained in an information system (including computer software, a database, graphic interface design, etc.) that can be accessed from various user devices connected to the Internet through Mobile Applications.
Mobile Application – software for portable (mobile) devices installed or downloaded by the User onto such devices via various software platforms and intended to access the MoodBoss Service.
User – an individual who accepts the terms of the User Agreement, possesses full legal capacity, and owns a personal mobile device linked to a mobile-phone number.
Generated Password – a unique sequence of characters sent by the Service to the User via SMS to the Contact mobile-phone number for accessing the Application Account. Together with the Login (the mobile-phone number), the Generated Password is equivalent to the User’s handwritten signature, confirming that the actions performed with that Login and Password originate from the User.
Push Notification – a message that pops up on the screen of the User’s Mobile Device, which is registered in the Service’s information system and is delivered from the Service’s server to the MoodBoss Mobile Application installed on the User’s device.
SMS Message – a short text message sent to the Contact mobile-phone number of the User’s device. SMS messages may be sent by the Service for informational purposes.
Operator – a government body, municipal body, legal entity, or individual which, independently or jointly with other legal entities within its group, organizes and/or performs the processing of personal data and determines the purposes for processing personal data, the scope of personal data to be processed, and the actions (operations) performed with personal data, such as collection, recording, systematization, accumulation, storage, updating (revision, alteration), retrieval, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, and destruction. The Operator may process Personal Data by automated or non-automated means.
Cross-border Transfer of Personal Data – the transfer of personal data to the territory of a foreign state, to a foreign state authority, foreign individual, or foreign legal entity.
Destruction of Personal Data – actions that render it impossible to restore the content of personal data within a personal-data information system and/or that destroy the tangible media containing personal data.
Personal Data – any information that the User provides about himself/herself when registering an Account or logging in, as well as in the course of further use of the Application.
Personal-Data Information System – a set of personal-data databases and the information technologies and technical means that ensure their processing.
Depersonalization of Personal Data – actions that make it impossible, without additional information, to determine whether personal data belong to a specific personal-data subject.
Processing of Personal Data – any action (operation) or set of actions (operations) performed with or without the use of automation with personal data, including collection, recording, systematization, accumulation, storage, updating (revision, alteration), retrieval, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, and destruction.
Account – a personal section of the Application that the User accesses after registration and/or login. The Account stores the User’s personal data and allows viewing and managing the Application’s available functions and the corresponding terms of use.
Registration in the Application – the set of actions performed by the User to enter the required data in the relevant Application fields. By registering in the Application, the User confirms compliance with the requirements set out in the User Agreement and this Policy.
Identification Data – the login and password, as well as other data (access codes, etc.) whose entry by the User makes it possible to identify the User. The procedure for assigning and/or obtaining Identification Data is specified in the User Agreement.
1. General Provisions
The MoodBoss Service (hereinafter the “Service”) is a set of Mobile Applications for iOS and Android platforms that enables users to track their partner’s emotional “weather” depending on the day of the cycle.
The mobile apps and related web services are owned and operated by Lazar Aleksandrovich Shaulov.
By using the MoodBoss mobile applications you acknowledge that you have read and understood this Privacy Policy and the data-collection and processing practices described herein.
The most recent changes to this Privacy Policy were made on 29 April 2025. Other revisions may be introduced from time to time; please review it periodically to stay informed of updates.
2. Scope of Regulation
This Privacy Policy describes in detail the rules and methods for collecting, using, and disclosing information that relates to you.
We understand that by providing information online you place your trust in us. We greatly value that trust and therefore ensure robust protection and a high degree of confidentiality for your personal data.
3. Conditions for Collecting and Storing Personal Data
By completing registration, the User gives consent to the processing of his/her personal data—namely, to the actions specified in paragraph 3, part 1, article 3 of Federal Law No. 152-FZ of 27 July 2006 “On Personal Data”—and confirms that such consent is given freely, by his/her own will, and in his/her own interest.
3.1
The User must be informed of the terms of use of his/her personal data before processing begins. The User’s consent to personal-data processing is specific, informed, and conscious.
3.2
This consent applies to the processing of the following personal data:
- surname, first name, patronymic;
- place of residence (country, city, region);
- telephone numbers;
- photographs;
- integrated data imported from social networks linked to the User’s Account.
3.3
By this consent, the User grants the Service the right to perform the following actions (operations) with personal data:
- collection and accumulation;
- storage for the periods stipulated by regulatory documents for record retention, but not less than three years from the date the User stops using the Service;
- updating (revision, alteration);
- use for the purpose of registering the User in the Service;
- destruction;
- transfer upon a court request—including to third parties—subject to measures that protect personal data against unauthorized access.
3.4
The User may withdraw consent to personal-data processing by sending a personal statement to l.shaulov@moodboss.com. Upon withdrawal, the Operator will stop processing the personal data and destroy them within 30 calendar days of receiving the statement, except for data that must be retained under Russian law. In such case, the Operator will keep depersonalized data in its database systems.
3.5
The Operator is not responsible for the completeness or currency of Users’ information. The User may at any time independently edit the Personal Data provided during registration or login in his/her Account.
3.6
The Operator may conduct cross-border transfers of personal data to a foreign legal entity in order to fulfil a contract with the User. Once the stated purposes are achieved, the Operator may guarantee destruction of the User’s Personal Data in the foreign territory.
3.7
The Operator stores Personal Data and protects them from unauthorized access and dissemination in accordance with internal policies and regulations. Personal Data remain confidential except where the Application’s technology or the settings of the software used by the User provide for an open exchange of information with other Application Users or Internet users at large.
3.8
The Operator may transfer Personal Data to third parties in the following cases:
3.8.1 The User has expressly consented to such actions.
3.8.2 In connection with the transfer of the Application into the possession, use, or ownership of a third party, including the assignment of rights under contracts concluded with the User in favor of that third party.
3.8.3 Upon request of a court or another authorized state body in accordance with legal procedure.
3.8.4 To protect the Operator’s rights and lawful interests in relation to breaches of contracts concluded with the User.
